Apply for Construction Noise Waiver

Does your construction project have an urgent need to work outside the regular work hours of 8:00 a.m. to 6:00 p.m. or on Sundays or holidays?

If yes, then you need to apply for a construction noise waiver. The City of Miami prohibits any noise disturbances outside regular work hours of 8:00 a.m. to 6:00 p.m. or on Sundays or holidays, to maintain the quality of life in our neighborhoods. But we recognize that sometimes public safety concerns require that construction work be done outside regular work hours, so the City created the noise waiver process.

Start early

You will need to submit your noise waiver application at least 10 business days before you plan to work outside regular hours of 8:00 a.m. to 6:00 p.m. or on Sundays or holidays. But, as you can see below, there are few tasks you need to complete before submitting.

Notify neighbors

As part of the application, you must provide proof that abutting property owners have been notified by Certified Mail. To make the task easier, we have linked a form letter below . If you’re not sure who needs to be notified, download the simple diagram that will guide you. Keep your Certified Mail receipts and scan them into a file that you will upload with your application. If you don’t provide proper proof of notification the application will be rejected.

Apply online

Now that you’re ready, go to miamigov.com/noisewaivers to apply. Remember, apply within 10 business days before you plan to work outside the regular work hours of 8:00 a.m. to 6:00 p.m. or on a Sunday or holiday.

Once your application is reviewed, copies will be provided to the area’s Police Commander, Code Compliance Supervisor and Commissioner’s Office, for input.

If you are the contractor or developer you will be notified once the application is approved or rejected.

IMPORTANT: Copies of approved construction noise waivers must be on site always and available if requested by any Police officer or officials from Code Compliance, Public Works, Building or NET departments.
